Can Foreigners Buy Property in Azerbaijan in 2026

Foreign citizens can generally acquire apartments, houses, commercial premises and other buildings and register ownership in their own name. The principal restriction concerns land: foreigners and foreign legal entities cannot directly own land in Azerbaijan and may generally hold land only under lease rights.

This distinction is particularly important when buying a house, villa or other property that includes a separate land plot. Buying an apartment in a registered multi-unit building is usually more straightforward because the transaction primarily concerns ownership of the apartment rather than direct ownership of an individual land plot.

Property rights in Azerbaijan are recorded in the State Register of Real Estate. State registration legally confirms the creation, transfer, restriction and termination of rights to real estate.

Buying Real Estate in Azerbaijan

Foreign citizens can buy real estate in Azerbaijan other than land, subject to the normal legal and registration requirements. In practice, a foreign buyer can acquire:

  • an apartment;
  • a residential house or villa as a building;
  • commercial premises;
  • offices and retail units;
  • other registered buildings and structures.

The State Service on Property Issues confirms that foreign investors can participate as buyers in property privatisation, with land specifically excluded because of the foreign-ownership restriction. Official historical statistics from the same authority also record thousands of real estate purchases by foreign citizens, confirming that property ownership by foreigners is established in practice.

Once a transaction is completed, the new ownership right should be entered in the State Register of Real Estate. The official extract from the register is the key document confirming registered ownership. For anyone buying real estate in Azerbaijan, the legal status of the property is therefore at least as important as the purchase contract itself.

Can Foreigners Buy Land in Azerbaijan

Foreign citizens cannot directly own land in Azerbaijan. Article 48.3 of the Land Code provides that foreigners, stateless persons, foreign legal entities, international organisations and foreign states may acquire land plots in Azerbaijan only on the basis of lease rights. This restriction applies regardless of whether the land is intended for a residential house, commercial development or another purpose.

As a result, a foreigner buying a detached house should not assume that ownership of the building automatically gives them ownership of the underlying plot. The legal rights to the house and to the land need to be examined separately. A lease right to land can itself be legally significant and may be registered where required, but it is different from freehold land ownership.

What Happens if a Foreigner Inherits Land

There are limited circumstances in which land ownership may temporarily pass to a foreign individual or foreign legal entity. The State Service on Property Issues explains that this can occur through:

  • inheritance;
  • gift;
  • certain mortgage-related transactions.

However, the foreign owner must dispose of the land within one year. If the land is not transferred within that period, it may be subject to compulsory acquisition under the procedure provided by law.

Can a Foreigner Buy a House in Azerbaijan

A foreigner can buy a house in Azerbaijan, but buying a detached house is legally more complex than buying an apartment. The building itself may be owned by the foreign buyer. The land underneath or around the house, however, cannot normally be registered as their private land ownership.

This means that before buying a house or villa, a foreign purchaser should establish:

  • who legally owns the land;
  • whether the land is privately owned, state-owned or municipal;
  • what right the buyer will have to use the plot;
  • whether a land lease is registered;
  • the term and conditions of the lease;
  • whether the house itself is registered separately;
  • whether the actual building corresponds to its registered technical documentation.

This is particularly important for villas on the Absheron Peninsula and other areas where detached houses are often sold together with substantial plots. The buyer should avoid relying solely on the seller’s description that the property is being sold «with land.» For a foreign buyer, the land rights require separate legal analysis.

Buying an Apartment in Azerbaijan as a Foreigner

For many foreigners, buying an apartment is the simplest form of buying property in Azerbaijan. A foreign buyer can acquire an apartment in their own name and register the ownership right in the State Register of Real Estate. Apartments are available on both the primary and secondary markets.

On the secondary market, buyers should verify that the seller has a valid registered ownership right and that the property is free from mortgages, arrest orders or other encumbrances. For a newly completed apartment, the registration status of the entire building should also be checked.

The State Service on Property Issues explains that, when an apartment is purchased in a building developed by an LLC, buyers should first verify whether the developer’s ownership rights to the building have been registered. Where the building has an official extract, a notarised sale and purchase agreement can serve as the basis for registering ownership of the apartment. Buying an apartment that already has a state-register extract generally reduces legal uncertainty compared with buying rights to a unit that has not yet been fully registered.

Where Foreigners Buy Property in Azerbaijan

Most foreign demand is concentrated in Baku and the surrounding Caspian coast, although property is also available in regional cities and tourist destinations.

Baku

Baku has the largest and most liquid property market in Azerbaijan. Foreign buyers can choose between:

  • resale apartments in established central districts;
  • new residential complexes;
  • premium waterfront developments;
  • apartments intended for long-term rental;
  • commercial property.

Central districts such as Sabail, Nasimi and Narimanov tend to command higher prices, while other parts of the city can provide lower entry costs. For investors, Baku generally offers a deeper long-term rental and resale market than smaller Azerbaijani cities or seasonal destinations.

Sea Breeze

Sea Breeze is a major resort and residential development on the Caspian coast near Baku. The project offers apartments, villas, townhouses and serviced or investment-oriented residences across numerous completed and under-construction developments. The developer markets property directly to international buyers and states that full property ownership is available to foreign citizens.

For apartments, the foreign-ownership structure is generally more straightforward. With villas and townhouses, buyers should pay particular attention to how rights to the underlying land are structured because Azerbaijan’s statutory restriction on foreign land ownership still applies.

Foreign buyers considering Sea Breeze should check:

  • what exactly is being registered in their name;
  • whether the unit receives an individual state-register extract;
  • whether the project is completed or off-plan;
  • how land rights are structured;
  • the delivery date;
  • finishing specifications;
  • maintenance and management fees;
  • rental-management conditions;
  • resale restrictions, if any.

Sea Breeze currently includes both completed properties and projects scheduled for completion over the coming years.

The Absheron Peninsula includes suburban housing, coastal villas and new residential developments outside central Baku. It can offer more space and lower prices than central parts of the capital. However, land documentation becomes particularly important when buying detached houses. Foreign buyers should establish whether the building and land have separate registration documents and precisely what land-use rights will transfer with the property.

Other Regions

Other Regions

Foreigners can also consider property in cities such as Sumgait and tourist destinations such as Gabala. Regional property generally has lower entry prices than prime Baku real estate, but resale liquidity and rental demand can also be lower. For an investment purchase, lower price alone should therefore not be treated as an indicator of better value.

How to Buy Property in Azerbaijan

The exact process depends on whether the buyer is purchasing a completed apartment, resale property, house or off-plan unit. A typical purchase can be divided into five stages.

Step 1. Choose the Property

The buyer should first determine:

  • budget;
  • intended use;
  • preferred location;
  • completed or off-plan property;
  • personal use or investment;
  • apartment or detached property.

For foreigners, one of the first questions should also be whether the transaction involves individual rights to land.

Step 2. Check the Ownership Documents

Before paying a substantial deposit or purchase price, the buyer should verify the seller’s legal title. For registered property, this includes checking the State Register of Real Estate. The official ASAN procedure for notarising a real estate sale requires a document proving ownership as well as a certificate confirming whether the property is subject to an encumbrance or arrest.

A buyer should verify whether there are:

  • mortgages;
  • court restrictions;
  • arrest orders;
  • registered leases;
  • other third-party rights.

Step 3. Check the Technical Documentation

The legal property should correspond to the physical property the buyer has inspected. Relevant documentation can include:

  • technical passport;
  • floor plan;
  • registered area;
  • number and use of rooms;
  • building commissioning documents;
  • documentation for alterations;
  • land plan for a detached house.

Unregistered extensions, additional floors or substantial changes to layouts can create problems when the property is later sold, mortgaged or re-registered.

Step 4. Sign the Sale and Purchase Agreement

A registered real estate purchase is formalised through the applicable notarial procedure. The official ASAN requirements include the seller’s ownership document and confirmation regarding encumbrances. Depending on the seller’s family status and persons registered in the residential property, additional consents may also be required.

Both the buyer and seller can participate personally or through properly authorised representatives. A foreign buyer using a power of attorney should ensure that the document is valid for use in Azerbaijan and grants the representative sufficient authority for the particular transaction.

Step 5. Register Ownership

The acquisition should then be reflected in the State Register of Real Estate. Azerbaijan’s Law on the State Registry of Real Estate defines registration as the state’s legal recognition and confirmation of the transfer of the property right.

For repeat registration of an apartment following a notarised transaction, ASAN lists the application, identity document, transaction document and payment of the applicable state fee among the required documents. The buyer ultimately receives an extract confirming the registered right.

Documents Foreigners Need to Buy Property in Azerbaijan

The exact document package depends on the transaction, but the foreign buyer will normally need identification documents and the documents supporting the acquisition. Typical documents include:

  • valid passport;
  • documents required to identify the foreign buyer for the notarial procedure;
  • notarised power of attorney if a representative acts for the buyer;
  • sale and purchase agreement;
  • seller’s registered title document;
  • information on encumbrances;
  • technical documents for the property;
  • documents relating to the underlying land where relevant;
  • evidence of payment of applicable fees.

Foreign documents may need translation and appropriate certification depending on where they were issued and how they are being used. The seller’s documentation is equally important. A buyer should not treat a contract with a seller as a substitute for evidence that the seller actually has the registered right to dispose of the property.

Buying New-Build Property in Azerbaijan

Buying new-build property requires additional checks because some units are sold before the final ownership registration is available. Azerbaijani legislation permits the pre-registration of rights to incompletely constructed real estate in qualifying cases. The Law on the State Registry of Real Estate provides that property rights to incompletely constructed real estate may be preliminarily registered based on the relevant construction-permit documents and plan.

Rights relating to apartments or non-residential premises forming part of an unfinished building can also be pre-registered. This is an important protection for off-plan buyers, but its availability depends on the legal status and documentation of the particular project.

Before buying off-plan, check:

  • the identity of the legal developer;
  • its rights to develop the site;
  • construction permits;
  • whether preliminary registration is available;
  • the unit number and area;
  • completion deadline;
  • conditions allowing extensions to the deadline;
  • instalment schedule;
  • penalties for buyer default;
  • developer liability for delay;
  • circumstances in which the contract can be cancelled;
  • refund arrangements;
  • final registration procedure.

A low off-plan price should be assessed against construction, completion and registration risks.

Buying Property in Sea Breeze as a Foreigner

Sea Breeze is particularly relevant to foreign purchasers because the development actively targets the international market. The project includes:

  • apartments;
  • private villas;
  • townhouses;
  • branded residences;
  • hotel-related residences;
  • completed and off-plan properties.

The official Sea Breeze project catalogue contains developments with delivery dates extending beyond 2030, so buyers need to distinguish clearly between completed real estate and property still under development.

For an off-plan unit, buyers should examine the purchase agreement rather than relying only on the project’s general marketing materials. For villas or townhouses, the land issue deserves specific attention. Even where a developer describes the property as being available in full ownership to a foreign citizen, the rights to the building and rights to the underlying land should be identified separately in the legal documentation.

For investors planning to use a managed rental programme, it is also important to understand:

  • management commission;
  • operating and maintenance fees;
  • owner’s personal-use restrictions;
  • responsibility for furnishing;
  • how rental income is calculated;
  • vacancy risk;
  • termination conditions.

Costs of Buying Real Estate in Azerbaijan

In addition to the purchase price, a buyer should budget for notarial, registration, technical and professional costs. For a standard transfer to an unrelated person, ASAN currently lists the following state and service fees for approval of the real estate purchase agreement:

  • Baku: €145 state fee + €22 service fee;
  • Sumgait, Ganja and Absheron: €102 + €15;
  • other cities and districts: €73 + €11.

Registration and technical-document charges may apply separately. Current ASAN tariffs should be checked for the particular property and type of registration because charges can differ for apartments, houses, commercial property and accelerated processing.

Other potential costs include:

  • document translation;
  • power-of-attorney formalities;
  • legal due diligence;
  • valuation;
  • renovation;
  • furniture;
  • compulsory property insurance;
  • building service charges;
  • developer or resort management fees.

ASAN notes that compulsory insurance applies to real estate owned by individuals and legal entities.

Taxes for Foreign Property Owners

Foreign ownership can create several tax obligations depending on how the property is used.

Resident and non-resident individuals owning buildings in Azerbaijan are subject to property tax. For residential property, the municipality calculates the tax on the portion of the dwelling exceeding 30 m².

The statutory rates include:

  • Baku — €0.2 per m²;
  • Ganja, Sumgait and Absheron district — €0.16 per m²;
  • other cities and regional centres — €0.1 per m²;
  • certain smaller settlements — €0.05 per m².

For Baku, an additional location coefficient between 0.7 and 1.5 applies.

Tax on Rental Income

Rental income is also taxable. As of 2026, the State Tax Service states that income received by an individual from renting residential premises owned by that individual to another individual is generally subject to 10% tax. Other rental income from movable and immovable property can be subject to a 14% withholding rate under the relevant rules. The applicable treatment therefore depends on the property, tenant and structure of the rental arrangement.

Tax When Selling Property

The sale of real estate can also generate simplified tax. The notary approving the real estate disposal transaction calculates and transfers the applicable simplified tax to the state budget. The tax can depend on the property’s area, type and location, and exemptions may apply in specific circumstances. It should therefore be calculated for the particular sale rather than assumed as a fixed percentage of the selling price.

Can Buying Property Give a Foreigner Residence in Azerbaijan

Qualifying property ownership can provide a legal basis for applying for temporary residence, but buying any property does not automatically grant residence. Under the current Migration Code information published by the State Migration Service, a foreigner who owns real estate in Azerbaijan worth at least €52,000 can qualify to apply for a temporary residence permit on that basis.

The applicant must provide evidence of ownership and valuation and satisfy the other migration requirements. Property purchase and residence status should therefore be treated as two separate procedures:

  1. the buyer acquires and registers the property;
  2. the foreign owner applies separately to the State Migration Service for residence.

A qualifying property does not automatically produce a residence card at the time of purchase. For permanent residence, additional conditions apply, including the required period of qualifying temporary residence.

Can Foreigners Get a Mortgage in Azerbaijan

Foreign buyers should distinguish between Azerbaijan’s state-supported mortgage programme and commercial financing offered by individual banks. The Azerbaijan Mortgage and Credit Guarantee Fund’s standard mortgage programme requires the borrower to be a citizen of the Republic of Azerbaijan. The loan must also be denominated in Azerbaijani manat and used to purchase residential property whose ownership rights are registered with the state.

Foreign citizens therefore cannot rely on this state-backed mortgage route. Whether a foreign buyer can obtain separate commercial financing depends on the lending policy of the particular bank, the applicant’s residency status, income, collateral and other underwriting requirements. For this reason, many foreign purchasers should structure their property search on the assumption that financing may be more limited than for Azerbaijani citizens.

Risks When Buying Property in Azerbaijan

Buying property in Azerbaijan can be relatively straightforward when the asset is fully registered, but several risks require attention:

  • Unregistered ownership. A seller may have contractual rights to a property without having completed state registration. This is especially relevant to some new developments and older buildings.
  • Encumbrances. A property can be subject to a mortgage, restriction, arrest or another registered third-party right. The official notarial procedure specifically requires information about encumbrances before a sale is approved.
  • Land ownership restrictions. This is one of the most significant issues for foreigners buying houses and villas. The buyer needs to understand exactly how the land is held and what rights remain available after the building is transferred.
  • Off-plan construction risk. Projects under construction may be delayed or changed. Buyers should review construction permits, registration status, payment schedules and the developer’s contractual obligations.
  • Discrepancies in property specifications. The physical apartment or house may differ from the area, layout or use registered in official documents. This can complicate future registration, financing and resale.
  • Rental return risk. For investment purchases, advertised rental yields are not guaranteed. This is particularly relevant in resort projects, where occupancy can vary substantially by season.

What to Check Before Buying Property in Azerbaijan

Before completing a purchase, a foreign buyer should verify at least the following:

  • identity and authority of the seller;
  • registered ownership right;
  • current state-register extract;
  • mortgage and encumbrance status;
  • technical passport;
  • official floor area and layout;
  • building commissioning status;
  • developer’s authority and permits for a new build;
  • preliminary registration for an off-plan unit, where applicable;
  • legal rights to the land for a house or villa;
  • outstanding building or management payments;
  • terms of any rental-management agreement;
  • conditions governing resale;
  • taxes and transaction costs.

The most important principle is to verify the rights that will actually be registered in the buyer’s name rather than relying solely on the commercial description of the property.

FAQ about buying real estate in Azerbaijan

Yes. Sea Breeze offers apartments, villas and other residential property to foreign buyers. However, for villas and townhouses, the legal structure of the underlying land should be checked separately because national restrictions on foreign land ownership continue to apply.

Can a foreigner register property in their own name?

Yes, for real estate that foreigners are legally permitted to own, such as an apartment or building. Direct registration of private land ownership in a foreign citizen’s name is restricted.

Does buying property in Azerbaijan give residency?

Not automatically. However, ownership of real estate worth at least €52,000 is currently one of the statutory grounds on which a foreigner may apply for temporary residence.

What documents are required when buying real estate in Azerbaijan?

The transaction typically requires identification documents, the seller’s title document, confirmation regarding encumbrances, the sale and purchase agreement and documents needed for state registration. Additional documentation may be required for houses, off-plan properties or transactions completed through a representative.
